TERMS AND CONDITIONS
1. Premises and Identity of the Owner
Having said that, a privacy policy is a statement that discloses some or all of the ways a website collects, uses, discloses, processes, and manages the data of its visitors and customers. It usually also includes a statement regarding the website's commitment to protecting its visitors' or customers' privacy, and an explanation about the different mechanisms the website is implementing in order to protect privacy.
Different jurisdictions have different legal obligations of what must be included in a Privacy Policy. You are responsible to make sure you are following the relevant legislation to your activities and location.
Privacy Policy - The Basics
For the purposes of these General Conditions, the following definitions apply:

User: any person who browses the Site, including Customers.

Customer: the User who places an order; they may be a Consumer (a natural person acting for purposes outside of their professional or business activity) or a Professional/Company.

Products: the handcrafted jewelry, accessories, and any related services offered on the Site.

Contract: the sales agreement concluded remotely between Pilgiò and the Customer.

CG: these General Conditions of Sale and Use (also known as the “Terms and Conditions”).
3. Scope of Application

The GTC apply to all sales made through the Site in Italy, the EU and non-EU.

Any special conditions (e.g. pre-orders, custom-made products, promotional campaigns) prevail over the GTC in the event of a conflict.

The Customer is required to download, save and/or print a copy of the General Terms and Conditions in force on the date the order is placed.
4. Acceptance of the GTC
By placing an order, you acknowledge and accept the Terms and Conditions, the Privacy Policy, and the Cookie Policy.
5. Requirements for Using the Site
Age of majority (18 years) or capacity to act under the laws of the country of residence.
For companies: possession of the professional and tax requirements required in the country of establishment.
Prohibition of using the Site for purposes that are illicit, fraudulent, or injurious to the rights of others.

7. Formation of the Contract

Information on the Products constitutes an invitation to offer.

The Contract is concluded when Pilgiò sends the Customer the order confirmation in electronic format (e-mail).

Pilgiò may refuse or cancel orders (with a full refund) in the event of:
a) unavailability of the Product;
b) payment anomalies;
c) fraudulent use of cards or data;
d) material error in the price or description.
8. Prices, Currency and Taxes

All prices are expressed in Euros (€) and, unless otherwise indicated, include applicable VAT.

For shipments outside the EU, the Customer is responsible for duties, import taxes and customs charges, which are not calculated at checkout.

Pilgiò may change prices at any time; the price indicated at the time of ordering will prevail.
9. Payment Methods

10. Billing

Professional/Business Customers must enter their correct tax information (VAT number, SDI/PEC code) when placing the order.

The electronic invoice is issued within the legal deadlines and transmitted via SDI; a courtesy copy is sent via email.
11. Availability and Artisan Production

Due to the handcrafted nature of the product, pieces and finishes may differ slightly from the images.
-
Some Products are made-to-order and require production times indicated in the item description.
-
In the event of subsequent unavailability, Pilgiò will inform the Customer and offer: replacement, voucher or refund.
12. Shipping and Delivery
ITALY – We ship with DHL or GLS; delivery takes approximately 1-3 business days and includes tracking.
EUROPEAN UNION COUNTRIES – We use DHL Express; average delivery times are 2-5 business days, with tracking always available.
NON-EU COUNTRIES – We ship via FedEx or DHL Express; delivery typically takes 3-10 business days (plus any customs clearance time), with tracking included.
Shipping costs are calculated and displayed transparently before you confirm your order.
The delivery times start from the moment the package is handed over to the courier.
Pilgiò is not responsible for delays due to the courier, customs procedures or force majeure.
13. Retention of Title
The Products remain the property of Pilgiò until full payment of the price and additional costs.
14. Right of Withdrawal (EU Consumers only)

Deadline: 14 days from receipt of the Products (articles 52 et seq. of Legislative Decree 206/2005).
-
Method: Written notification via email or standard form; return within 14 days.
-
Conditions:
-
Products intact, unworn, complete with packaging, seals, and certificates.
-
Exclusions: personalized or made-to-measure items (Article 59 of the Consumer Code).

Costs: return shipping to be paid by the Consumer.
-
Refund within 14 days of receipt of the return or proof of shipment, using the same payment method.
15. Legal Guarantee of Conformity
Duration: 24 months for Consumers, 12 months for Professional Customers (unless otherwise mandatory).
It covers defects of conformity existing at the time of delivery.
The Customer must report the defect within 2 months of discovery.
Remedies: repair, replacement, price reduction or termination of the Contract.
16. Commercial Guarantee and Material Certification

In addition to the legal guarantee, Pilgiò issues a Certificate of Authenticity for the fineness of the precious metals and stones used.

Galvanic finishes are subject to natural wear and tear; such phenomena do not constitute a lack of conformity.

17. Returns for Defects or Damage During Transport
The Customer must check the integrity of the package upon delivery and, if necessary, sign with reservation of inspection.
Please send photos and a description of the damage to info@pilgio.com within 48 hours.
Pilgiò will organize the collection at its own expense and will proceed with the remedies set forth in Article 15.
18. Limitation of Liability

Except in the case of fraud or gross negligence, Pilgiò is only liable for the value of the purchased Product.

We assume no responsibility for individual allergies to metals or components unless previously communicated by the Customer.

The images and colours of the Products on the Site may differ from the actual ones due to monitors and graphic settings.
19. Intellectual Property

20. Indemnity

21. Suspension and Maintenance of the Service
Pilgiò may temporarily suspend the Site for maintenance, security updates, or reasons of force majeure, without this entailing any liability for any unavailability.
22. Assignment of Contract
Pilgiò may assign the rights and obligations arising from the GTC to third parties, while still guaranteeing the Customer's rights. The Customer may not assign the Contract without Pilgiò's written consent.
23. Changes to the GTC

Pilgiò may update the GTC; the updated version is published on the Website with the effective date.

Orders already confirmed remain governed by the previous version, available upon request.
24. Applicable Law and Jurisdiction

The General Terms and Conditions are governed by Italian law, without prejudice to the Consumer's mandatory rights in his or her country of residence.

Consumers: court of the place of residence/domicile.
-
Professionals/Companies: exclusive jurisdiction of Milan.
25. Alternative Dispute Resolution (ADR/ODR)
Consumers residing in the EU can submit a complaint online through the European Commission's ODR platform at https://ec.europa.eu/odr . Pilgiò is available to attempt an amicable solution through these bodies.
26. Safeguard Clause
The invalidity or ineffectiveness of a clause does not affect the validity of the remaining provisions, which will remain fully applicable.
